1. Acceptance of Terms

By accessing, browsing, or purchasing through JBC Construction Equipment, you agree to these Terms and Conditions. If you do not agree, please discontinue use of this website and services.

2. Nature of Goods – Used / Second-Hand Equipment

All machinery, vehicles, tools, and equipment sold by JBC Construction Equipment are used / second-hand. Reasonable signs of wear, prior use, age-related condition, and cosmetic imperfections should be expected.

Listings are provided in good faith based on available information. Buyers are encouraged to ask questions and request additional photos or videos prior to purchase. Where feasible, inspections may be available by appointment, and buyers may use a third-party inspection service at their expense.

3. Sales to Businesses and Individuals

We sell used machinery to both commercial (B2B) buyers and private individuals.

For commercial / business buyers, transactions are governed by applicable provisions of the Uniform Commercial Code (UCC). Implied warranties of merchantability and fitness for a particular purpose are disclaimed to the fullest extent permitted by law unless expressly stated otherwise in writing.

For individual / consumer buyers, statutory consumer rights under applicable U.S. federal and state laws apply, subject to limitations permitted for the sale of used goods.

4. Ordering Process, Availability, and Acceptance

Inventory availability can change quickly. An order is not considered final until it is confirmed by JBC Construction Equipment and payment has been received and cleared.

By completing a purchase, the buyer confirms they have reviewed the listing details and the written terms shown on the invoice or sales agreement, including warranty coverage and any unit-specific conditions.

5. Descriptions and Listings

All descriptions, photographs, specifications, hours, mileage, and manufacturing year are provided in good faith. Errors or omissions may occur and do not constitute misrepresentation. If you need verification of a specific detail, please request confirmation in writing before purchase.

6. Pricing, Payment, and Sales Tax

Prices are subject to change without notice. Full payment must be received and cleared prior to release or delivery of any equipment.

We accept credit cards, debit cards, and bank wire transfers. Available payment options and instructions are provided on the checkout page and/or on the invoice issued by JBC Construction Equipment.

Applicable sales tax will be charged in accordance with state and local requirements unless a valid exemption certificate is provided prior to billing.

7. Warranty

Every machine sold by JBC Construction Equipment includes a 12-month limited structural and mechanical warranty, unless otherwise stated in writing on the invoice or sales agreement.

This warranty covers major structural components and primary mechanical systems only.

The warranty does not cover consumable items (including filters, belts, fluids, and wear parts), normal wear and tear, routine maintenance, misuse, abuse, improper operation, accidental damage, unauthorized repairs, or failure to maintain the equipment in accordance with manufacturer recommendations.

Warranty claims must be submitted in accordance with the instructions provided on the invoice or sales documentation.

8. Limitation of Liability

To the fullest extent permitted by law, JBC Construction Equipment shall not be liable for:

  • loss of profits or business interruption
  • loss of use or downtime
  • transport or shipping delays
  • repairs or mechanical failures after delivery
  • indirect, incidental, or consequential damages

Liability, if any, is strictly limited to the purchase price actually paid for the equipment.

9. Delivery, Collection, and Transport

Delivery dates are estimates and depend on carrier scheduling and route availability. Risk of loss transfers to the buyer when the equipment is released for transport, loaded, or collected (unless otherwise required by applicable law).

Where transport is arranged by us, any insurance coverage is only as specified in writing on the invoice or shipping documentation.

For exports, customs documentation, duties, taxes, and compliance requirements are the responsibility of the buyer unless otherwise agreed in writing.

10. External Links & Third-Party Services

We are not responsible for the content, accuracy, or practices of third-party websites, carriers, inspection services, or service providers.

11. Cancellations & Refunds

We allow refunds for equipment purchases, subject to the conditions outlined below.

Requests for cancellation or refund must be submitted in writing and approved by JBC Construction Equipment.

Approved refunds may be subject to reasonable administrative, inspection, handling, transport, and/or storage fees.

Refunds are not available for:

  • equipment that has been used, modified, damaged, or altered after delivery
  • customized or special-order equipment
  • shipping or carrier costs already incurred

To be eligible for a refund, the equipment must be returned in substantially the same condition as delivered, excluding normal inspection-related handling.

Any approved refund will be processed after the equipment is returned, inspected, and approved by JBC Construction Equipment.

If approved, refunds are typically issued back to the original payment method after inspection and written confirmation of approval.

12. Governing Law & Jurisdiction

These Terms are governed by the laws of the State where JBC Construction Equipment operates, without regard to conflict of laws principles. Any disputes shall be resolved in the appropriate state or federal courts in that jurisdiction.

13. Changes to These Terms

We reserve the right to update or modify these Terms at any time. Continued use of the website or services constitutes acceptance of any revised Terms.
